Rogers & Associates’ consulting services are available to help plan sponsors with a wide variety of Plan related issues.  Our consultants can assist you with each stage of your Plan’s life, from the initial design of a new Plan all the way through Plan Termination.  We can also assist with Plan mergers and Spin-offs. 

 

IRS/DOL Issues

Call Rogers.  That has been  the recommendation to many plan sponsors by attorneysConsulting Services to help with all plan related issues and CPAs over the years.  Whether prospective clients come to us with defective plan designs, improper administration practices or non-compliance issues, generally, they are facing plan disqualification or enormous penalties.  Our consultants have the knowledge, experience, and expertise to address and resolve whatever IRS/DOL issues arise.

Initial Plan Design
There are several different types of retirement plans available today.  Each type of plan has its advantages and disadvantages.  The design process for new Plans starts with selecting the type of Plan that will best meet your goals, at which point one of our consultants will custom design a Plan tailored to meet your specific needs.  Just contact Rogers.
Takeover Plans

The Sarbanes-Oxley Act of 2002 imposed a new set of requirements on most Plans that are changing service providers.  If Participant’s ability to direct or diversify investments, or to obtain a loan or a distribution, are temporarily suspended for more than 3 consecutive business days, a Blackout Notice is required to be given to all affected Participants at least 30 days before the last day they are able to perform the action being suspended.  The penalties for not complying with the Blackout Notice requirements can be huge.  If your current service provider is unwilling or unable to provide a timely Blackout Notice, Rogers & Associates can prepare one for you.

 

Our consultants will review your existing Plan Document and make suggestions for improvements.   Some of the existing Plan features will have to be maintained, but significant changes to the Plan can still be made prospectively.  Whether your company has outgrown your current plan or you adopted a “plan in a box,” we can help customize your Plan to meet your needs.  At Rogers & Associates, we work for the client, providing the best possible service and administration to meet our client’s needs, not our own! Plan Terminations

In many ways, establishing a Qualified Plan is similar to getting married.  The process can be quick, involves legal documents and establishes a long term relationship.  In the same way, terminating or ending a Plan is similar to getting a divorce.  When the time comes to terminate your Plan, Rogers & Associates will assist you every step of the way, including:

 

Paperwork to stop benefit accrual and terminate the Plan

  • ERISA §204(h) Notices, if needed

  • Amendments needed to update the Plan for law changes
  • Filing for a determination letter with the IRS
  • Distribution paperwork
  • Valuations to determine distribution amounts
  • Forms 1099-R and 945
  • Final Form 5500, with all necessary Schedules and attachments
